Christmas Day murder trial: 5 things to know about Warren County case

A jury found Zachary Wilson, 26, guilty on all counts in the shooting death of Jeremy Foxx, 24.

The jury continued deliberating Thursday afternoon after another unusual development in the Christmas Day 2016 murder trial in Warren County.

They returned to the jury room about 12:30 p.m. after Judge Robert Peeler answered questions and corrected the instructions on a felonious assault charge.

It was the latest twist in the trial of Zachary Wilson, 26, on three counts of murder, two counts of felonious assault as well as single charges of improperly discharging a firearm and tampering with evidence.

Defense witness: Witness Brian Raby testified first out of the jury's view about a visit from Wilson, alleged victim Jeremy Foxx and Allison Moore, Foxx's cousin who is serving a prison term for tampering with evidence in the case. He then testified briefly in front of the jury, after both sides had closed their cases and made final arguments.

Mistrial request: Wilson's lawyers moved for a mistrial on Wednesday after Raby, a defense witness, appeared, six hours after he was subpoenaed to testify.

Deliberations: The jury adjourned to begin deliberations after hearing their instructions Wednesday night, but decided against beginning their work until today. They began deliberations about 8:45 a.m. and were still at it this afternoon.

Case details: The case stems from Foxx's fatal shooting on Dec. 25, 2016 as he, Wilson and Moore drove along the Franklin Twp.-Carlisle border. Testimony indicated they were planning to buy more methamphetamine to continue a binge begun four or five days earlier. Moore testified Wednesday Foxx pulled a gun on Wilson, contrary to earlier statements to investigators.

Earlier delay: The trial was delayed last year during jury selection after Peeler questioned attorney Bill Fowler's ability to represent Wilson.
