Springfield apartment complex sues, says ex-manager stole $30K in rent

One of the largest apartment complexes in Springfield has filed a civil lawsuit against a former employee, alleging she stole about $30,000 in cash and checks from the business over a span of about three years.

The lawsuit filed in Clark County Common Pleas Court by JRK Property Holdings Inc. accuses Amy Boggs of taking money from the Red Coach Village Apartment Homes in Springfield. The lawsuit also names Michael R. Lemmings as a defendant, alleging both he and Boggs took money from the company for their own use.

Boggs, 37, of 892 Alta Road in Springfield, previously pleaded not guilty to one count of felony theft in Clark County Municipal Court. The charge was dismissed by prosecutors in lieu of her completing a diversion program, according to court records.

The lawsuit filed late last month alleges Boggs intercepted checks and money orders meant for the company and either cashed them or deposited them into her personal bank accounts at Huntington National Bank. The complaint seeks at least $25,000, along with interest, costs and attorney fees.

Court records say management at JRK called police in May last year, alleging Boggs stole rent money while serving as property manager at the complex. She allegedly asked tenants to pay their rent with money orders, while leaving them blank. She would then fill in the money order with her own name or manipulate ones that had been addressed to Red Coach, court records say.

Company officials noticed the alleged theft after an employee filled in for Boggs while she was on vacation, police said, and noticed several tenants were overdue on their rent. The company also launched an internal audit and noticed discrepancies on several accounts. When questioned about the issue, police said Boggs didn’t return to work.

Several tenants produced receipts or copies of their money orders to show they paid their rent.

When questioned, Boggs allegedly told detectives she was addicted to Percocet until May 2016 and taking 30 to 40 pills a day, court records say.
