1 suspect charged, other released in double homicide

Charges have been approved for Davion Lyons, a second suspect that was arrested earlier this week in connection to the shooting deaths of Donald Nesbit and John Dixon on Victor Avenue Tuesday.

Lyons is charged with six counts of murder, six counts of felonious assault, four counts of aggravated robbery, four counts of aggravated burglary and two counts of having weapons under disability, according to the Montgomery County Prosecutor’s Office.

A second suspect, Lavelle Broadnax, who was arrested Wednesday in connection to the double homicide, was released from jail pending further investigation, the prosecutor’s office said.

UPDATE @12:48 p.m. (Dec. 1):

A second victim has died in the triple shooting that occurred Tuesday on Victor Avenue.

The Montgomery County Coroner’s Office confirmed that Donald Nesbit, 56, of Dayton died this morning at 6:19am at Miami Valley Hospital as a result of the shooting.

An autopsy is still being completed.

UPDATE @ 6:30 p.m. (Nov. 30): A 25-year-old man arrested early Wednesday remains in custody stemming from a homicide early Tuesday on Victor Avenue.

Dayton police arrested Lavelle Broadnax about 5 a.m. in the 1500 block of Dietzen Avenue. He is being detained in the Montgomery County Jail on a charge of murder and has a court appearance scheduled for Thursday, according to online jail records.

A supervisor of homicide detectives tells us a second person believed to have been involved in the incident is still being sought.

The supervisor did not say if Broadnax or the second person fired the fatal shots or whether both discharged weapons in the homicide.

UPDATE @ 7:50 a.m. (Nov. 29): The Montgomery County Coroner’s Office has identified the victim killed in a shooting on Victor Avenue as 40-year-old John Dixon, of Dayton.


Three people were shot inside a Dayton house, one fatally, while women and children were in hiding early Tuesday morning.

Officers and medics were dispatched at 1:53 a.m. to the 100 block of Victor Avenue on a reported shooting.

Dayton Police Lt. Andrew Gillig said one man was found shot and was pronounced dead at the scene.

Two other people, a man and a woman, were also shot during the incident and transported to Miami Valley Hospital.

Gillig said the man suffered life-threatening injuries and is listed in critical condition, while the woman was listed in serious condition.

The circumstances of the shooting are still under investigation, but Gillig said the incident appears to be a drug-related, home invasion attempt.

“We’re investigating the angle that drugs were being sold from this location, and this was a home invasion,” Gillig said.

When police arrived on scene a woman and children were found hiding in the upstairs part of the home, while a second woman was found hiding in the basement.

Gillig said the victims and the shooter knew each other, and are currently involved in a civil court case. Details and a description of the suspect were not released.

Witnesses are also working with investigators.

The aunt of the victim who was fatally shot had a message to the shooters, “You will get caught,” she said. “You might as well turn yourself in now.”

She said she saw her nephew on Thanksgiving and tried to tell him to get new friends.
