The Montgomery County Prosecutor's Office has filed a motion to have the officer-involved shooting case involving a 17-year-old moved to adult court, in addition to filing more charges against the suspect.
Prosecuting Attorney Mat Heck Jr. said the teen used a 0.45 caliber semi automatic weapon in robbing a Shell station at Ohio 725 in Miamisburg at the I-75 interchange.
Heck said he pointed the gun at an off-duty police officer and claimed to be an undercover FBI agent in an attempt to flee.
The Miami Township officer fired at the teen, wounding the suspect in the right arm after he "failed to comply" with the officer's order to drop the weapon.
The defendant used a stolen car to rob the Shell, Heck said. Heck said the teen's car broke down and he approached "a number of other vehicles" seeking to carjack them in an attempt to escape.
"We cannot and will not tolerate juveniles....terrorizing the community," Heck said.

Additional charges were filed against the 17-year-old suspect involved in the officer-involved shooting in Miamisburg on Feb. 5.
The Dunbar High School student was charged with seven counts of aggravated robbery, one count of felonious assault on a police officer, one count of impersonating an officer and a weapons charge, prosecutors said.

The Montgomery County Prosecutor’s Office has filed a motion to have the officer-involved shooting case involving a 17-year-old moved to adult court, according to juvenile court officials.
Additional charges also have been filed in the case, however the specific charges were not immediately available, officials said.

The Montgomery County Prosecutor is expected to make an announcement this morning regarding the case of the 17-year-old shot by an off-duty officer earlier this month.
A press conference is planned for 11:15 a.m.
INITIAL REPORT:
A 17-year-old Dayton defendant authorities said robbed a Miamisburg gas station and sought to escape by carjacking vehicles before being shot by an off-duty police officer is set to return to court today.
Miamisburg police said they expect more charges to be filed against the teen stemming from the Feb. 5 incident on Ohio 725. But as of late last week, juvenile court officials said that had not occurred.

He was charged Feb. 6 with aggravated robbery with a gun specification – a first-degree felony - after an unidentified off-duty Miami Twp. officer shot him at the Interstate 75 interchange. Traffic came to a halt at the interchange as several law enforcement agencies responded.
Aside from the off-duty officer, also near the scene on the afternoon of Feb. 5 were a DEA agent and two members of the Jackson Twp. Police Department, records show. The DEA agent initially told dispatchers on a 9-1-1 call the teen claimed to be an undercover officer.

The charge includes an accusation that he “did discharge the firearm at a peace officer or corrections officer while committing the offense,” court records show. Because of his age, it also makes him eligible to be tried as an adult, according to Ohio law.
When he entered a denial on the defendant’s behalf on Feb. 6, Montgomery County Juvenile Court Judge Anthony Capizzi told him “the charge itself is so serious, so potentially heinous. People in that gas station could have been killed. People at 725 and 75 could have been killed. Police officers – on and off duty – could have been killed.”
The defendant remains in juvenile detention after being wounded in the right arm. The judge said the teen has no prior criminal record.
