Plea negotiations ongoing with sub teacher accused in student sex case, prosecutors

The Kettering High School substitute teacher accused of having sex with two students had a hearing continued Wednesday as plea negotiations continue.

Madeline Marx, 23, was to appear in front of Montgomery County Common Pleas Court Judge Steven Dankof for a scheduling conference.

Before Dankof’s docket started, prosecutors said nothing would be put on the record. Marx and her attorney left the courtroom. Her next scheduled hearing will likely be next Wednesday.

Last week, Dankof ruled that Marx was competent to stand trial. Court documents indicated Marx and her attorney are in plea negotiations with prosecutors.

Marx was indicted on two counts of sexual battery (teacher) and alleged to have had committed sex acts with two teen boys in parking lots at a Big Lots and an apartment complex in Kettering.

A 17-year-old student told police he was given oral sex by a teacher July 19, 2017 in the parking lot of Big Lots on Wilmington Pike, according to the complaint, affidavit and statement of facts filed in municipal court.

A 16-year-old boy told police he had intercourse with a substitute teacher Sept. 21, 2017 in the parking lot of an apartment complex on Smithville Road, according to court documents.

Marx was removed from Fairmont’s building Nov. 8, 2017 by police. Marx admitted to having sexual relationships with multiple students, according to court documents.
