Sam Miller arrest: Dayton basketball’s recent history of incidents

Sam Miller is not the first Dayton Flyers basketball player who has landed in trouble.

Miller, 20, was arrested Sunday and charged with disorderly conduct by intoxication and underage consumption. On Monday, Miller was charged with misdemeanor assault after an incident in the Greene County Jail. He pleaded not guilty.

The 20-year-old junior forward’s troubles were preceded by other, separate incidents involving members of the Dayton Flyers team.

2015 — Dyshawn Pierre suspension upheld

In December 2015, a federal judge upheld the suspension of star University of Dayton basketball player Dyshawn Pierre, who was barred from the school and sports for fall semester after a hearing board determined he violated the university’s policy against unwanted sexual contact.

In his ruling, Judge Thomas M. Rose of the federal court in Dayton wrote that Pierre’s attorney failed to convincingly prove his various claims that UD’s process for determining Pierre’s guilt was biased or unfair.

Pierre’s suspension followed an allegation by a female student that he sexually assaulted her in April. Prosecutors determined there was insufficient evidence to charge him with a crime.

2015 — Devon Scott and Jalen Robinson sentenced

Devon Scott and Jalen Robinson were sentenced after walking up to several dorm room doors and trying handles to see if they were unlocked, according to the Montgomery County Prosecutor’s Office.

Scott was sentenced to a 90-day jail sentence, five years’ probation and $669 restitution to 16 victims after pleading guilty to his role in the on-campus burglaries.

Robinson was sentenced to 30 days in jail, five years’ probation and was ordered to pay restitution.

2014 — Devon Scott avoids jail in assault case

As part of a plea deal, prosecutors dropped an assault charge against Scott and amended a domestic violence charge to disorderly conduct, a fourth-degree misdemeanor. According to court documents, University of Dayton police brought the charges that accused Scott of “striking” and “dragging” Keonna Austin, the mother of his child.

Scott was sentenced by Judge Deirdre Logan to 40 hours of community service, a suspended 30-day sentence, a $250 fine with half of that suspended, and court costs.

2012 — Matt Kavanaugh investigated, suspended

Matt Kavanaugh was the suspect in a sexual assault investigation in fall 2012 that did not yield criminal charges, according to the Montgomery County Prosecutor’s Office. Around the same time, Kavanaugh was suspended for one year for violating the university’s standards of behavior and code of conduct, UD officials said.

“Obviously student disciplinary action is separate and distinct from any potential criminal charges,” Prosecutor Mathias H. Heck Jr. said in a statement released following an inquiry by the Dayton Daily News. “Improper behavior by students is not always criminal in nature, and in this instance the evidence did not support a criminal charge.”
