U.S. District Court Judge Thomas Rose ruled against Schroyer’s motion earlier this year. On Monday, Rose scheduled Schroyer’s sentencing for June 29.
In August, Schroyer pleaded guilty by bill of information to a misdemeanor count of making a “false, fictitious, or misleading” statement in connection with federal workers’ compensation benefits.

About six weeks later, she filed a motion to withdraw the plea.
Rose ruled that Schroyer’s motion may have been for strategic reasons, not just because of her claim of “actual innocence.”
Schroyer claims she didn’t understand the context of the questions by a special agent investigating her workers’ compensation, Rose wrote. The judge also wrote that Schroyer said she pleaded guilty “because she understood that her ability to prevail at trial would depend on a highly subjective assessment of her credibility.”

The judge noted the 90 minutes that Schroyer’s counsel spent negotiating the language of the plea agreement and that she said she understood the statement of facts.
“Her decision to seek withdrawal immediately followed an (Equal Employment Opportunity Commission) hearing, during which she learned that her guilty plea would adversely affect its outcome,” Rose wrote. “Schroyer also has not persuaded the Court of her factual innocence or the legal insufficiency of the Government’s case.”

A message seeking comment was not immediately returned by Schroyer’s attorneys.
On May 5, 2015, Schroyer reported to a supervisor that she was injured while attempting to lift a heavy package, according to the indictment.

Schroyer, a letter carrier, had claimed she couldn’t sit, stand or walk for more than five or 10 minutes at a time.
On May 7, 2015, a physician placed Schroyer on light duty and she submitted a claim, alleging she suffered an injury to her right side and pelvic area, documents indicate.

On June 13, 2015, Schroyer and her boyfriend flew from Dayton to Orlando, Fla. Schroyer “had a carry-on bag and walked without assistance through the Dayton International Airport,” the indictment said.
During a week-long vacation, Schroyer went to Aquatica, a water park at Sea World, where she was observed climbing several flights of stairs without assistance or difficulty, according to court documents.
