The baby was successfully delivered by c-section before Marsh died, a police affidavit said. Clark County Prosecutor Andy Wilson said the baby is still fine.
The affidavit says Hypes told police that he and Marsh got into an argument and began pushing each other. Hypes told authorities he brandished the gun but didn’t mean to use it, the affidavit said.
The gun allegedly went off during the pushing match, according to what Hypes told police in the affidavit.
But Marsh’s family doesn’t believe that’s what took place. They told the Springfield News-Sun that Marsh was protective of the baby and wouldn’t willingly get involved in a physical altercation.

Hypes was arrested while Marsh was fighting for her life and was originally charged with felonious assault. After her death, Clark County prosecutors upgraded the charges.
