Young victim confronts Tipp City man in sex case

TROY - A Miami County judge sentenced a Tipp City man convicted of sexual conduct with a minor to three years in prison after the victim said there “is not enough time in the world to make up for the emotional pain” suffered.

John Maingi, 38, originally was indicted by a county grand jury on two felony counts of rape and two felony counts of gross imposition.

The indictment alleged the offenses occurred between August 2011 and December 2016. One rape count stated the alleged victim was less than 10 years old. The second rape count stated the alleged victim was less than age 13.

Maingi later pleaded no contest and was found guilty of felony sexual battery and gross sexual imposition in county Common Pleas Court.

Under the plea deal outlined by defense lawyer Kevin Lennen in October, prosecutors recommended a three-year mandatory prison term.

The sentencing was scheduled Dec. 10 but continued by Judge Christopher Gee to allow prosecutors to subpoena the victim, who they said wanted to be in court but was prohibited by her mother.

The victim was in court Monday, spoke of how the offenses took away her childhood and asked for a maximum sentence.

Maingi declined comment before sentencing.

Janna Parker, an assistant county prosecutor, said the victim demonstrated strength and maturity . “We are grateful for her bravery to come forward,” Parker said.

Gee followed the recommend sentence after noting the victim suffered “significant psychological harm.”

Maingi was sentenced to three years in prison for sexual battery and given credit for 255 days served in jail.

He was sentenced to five years of community control for gross sexual imposition. As part of that sentence he will be required after prison release to follow a 9 p.m. to 6 a.m. curfew, have no contact with the victim and undergo sex offender and substance abuse assessments.

Maingi was designated a Tier III sex offender. The designation will require him to register his address with the sheriff in the county where he lives for the rest of his life following prison release.
